RESIDENTIAL RENTAL TERMS AND CONDITIONS
The undersigned tenant (“Tenant”) hereby acknowledges these Residential Rental Terms and Conditions (the “Terms and Conditions”) and agrees to follow them as a condition of obtaining access to any rental property operated by Darina Georgrieva d/b/a Naples Rent Away (“Landlord”).
These Rental Terms and Conditions supplement the Residential Rental Agreement which Landlord will provide to Tenant upon approval of Tenant’s reservation. Reserving online merely places the property on hold. Landlord will contact Tenant to confirm availability and any minimum stay. Tenant has no right of access to the rental property until the Residential Rental Agreement is fully executed and Tenant’s deposit is received.
- A deposit in the amount of 500$ is required to reserve a Naples Rent Away property. If the Naples Rent Away property is damaged during Tenant’s stay, Landlord may apply the deposit to repair of the damage. Otherwise, the deposit will be refunded within thirty (30) days of the conclusion of Tenant’s stay.
- Cancellation Policy. If Tenant cancels a reservation 14 or more days before the rental term was scheduled to begin, Landlord will refund 50% of the deposit. If Tenant cancels a reservation between 8 and 13 days before the rental term was scheduled to begin, Landlord will refund 20% of the deposit. If Tenant cancels a reservation 7 or fewer days before the rental term was scheduled to begin, the deposit is non-refundable.
- Check-In and Check-Out. Check-in is after 4:00 p.m. Check-out is promptly at 11:00 a.m.
- Tenant is responsible to pay the amount of rent stated in the Residential Rental Agreement.
- Additional Fees.
- Cleaning Fee. A cleaning fee of $350.00 per stay is required for all Naples Rent Away properties.
- Pool Heating Fee. Tenant has the option to purchase additional heating of the swimming pool for a fee of $150.00 per week.
- Pet Fee. Pets are not typically permitted at Naples Rent Away properties (see paragraph 8 below). If Landlord grants permission for a pet, or if Landlord discovers an unauthorized pet on Naples Rent Away property, Tenant will incur an additional fee of $150.00 per pet.
- Replacement Keys. If any key(s) or remote control(s) are lost during Tenant’s stay, Landlord will charge a $75.00 replacement fee.
- No Smoking. All smoking, including but not limited to cigarettes, cigars, and vapes, is absolutely forbidden at all Naples Rent Away properties.
- Quiet Enjoyment of Property. Naples Rent Away properties are located in quiet residential areas, and it is important to respect neighbors. Parties are not permitted at Naples Rent Away properties. Tenants must observe quiet hours from 10:00 p.m. until 7:00 a.m.
- Pets are generally not permitted at Naples Rent Away properties. Landlord will consider exceptions on a case-by-case basis. Tenant must disclose the pet and request permission from Landlord prior to execution of the Residential Rental Agreement.
Service animals and emotional support animals are not considered pets. In accordance with state and federal law, Landlord will not discriminate based on disability. If Tenant needs to bring a service animal to a Naples Rent Away property, Tenant must notify Landlord. If Tenant’s disability is not readily apparent, Landlord may request reliable information pursuant to § 760.27, Fla. Stat.
- Tenant acknowledges that pool and spa areas are not fenced. Tenant agrees to use pools/spas at Naples Rent Away properties responsibly. Tenant will be liable for any damage Tenant causes to pool and/or spa equipment through misuse or negligence.
- Tenant may not use the kayaks in any case due to liability and safety issues.
- Child Supervision. Naples Rent Away properties may contain conditions which are hazardous to unsupervised children, including but not limited to pools and kayaks. Tenant agrees that any child(ren) on Naples Rent Away property will be supervised by an adult at all times.
- Security Cameras. Landlord maintains security cameras for the exterior of Naples Home Away properties; however, in doing so, Landlord does not assume any liability to protect any persons or property from break-in, intrusion, other criminal acts, or acts of nature.
- Lost or Stolen Items. Landlord assumes no responsibility for lost or stolen items.
- Travel Insurance. Landlord does not provide travel insurance. Tenants interested in purchasing travel insurance coverage may do so via an independent travel insurance company such as Travel Guard, AXA, or AIG.
- Collier County Ordinances. Tenant agrees to comply with all applicable Collier County ordinances pertaining to short-term rentals, including but not limited to regulations of noise, parking, and garbage.
- Privacy Policy. Landlord will not sell Tenant information to third parties. Landlord may utilize website cookies for legitimate business purposes. Landlord undertakes commercially reasonable efforts to maintain the confidentiality of all Tenant information. Landlord is not liable for inadvertent disclosure of tenant information due to transmission errors or unauthorized access. If Landlord is legally compelled to release information to a third party, Landlord will make reasonable efforts to inform Tenant.
